Severance Pay When Fixed-Term Employment Contract Terminates

In Slovenia, the severance pay in case of termination of a fixed-term employment contract is not uniformly regulated for all workers with fixed-term employment. Whether worker has a right to severance pay and to which amount depends both on the manner in which the employment contract is terminated and the reason for its conclusion.
In Slovenia, the severance pay in case of termination of a fixed-term employment contract is not uniformly regulated for all workers with fixed-term employment. Whether worker has a right to severance pay and to which amount depends both on the manner in which the employment contract is terminated and the reason for its conclusion. The author questions the meaning of such legislative approach and exposes its legal ambiguities and inconsistencies. First, the author presents statistics on the employment relationship in the third quarter of 2019, it continues with general presentation of a fixed-term employment contract and methods of its termination. The central part is a review of the severance pay scheme and its amount, adding the rulings of the Court of Justice of the European Union. The final part outlines actions against the employer when it fails to pay severance pay upon termination of a fixed-
-term employment contract and the link between the severance pay and the employee’s social rights.
